Interview with team Presolv360, A Start-up capable of preventing needless litigation

This startup is capable of preventing needless litigation, protecting people and businesses from adversities of disputes and resolving them through time-tested collaborative dispute resolution mechanisms.

Here we introduce you with ‘Presolv360’ – India’s first dispute management platform. It is quick, cost-effective and the most efficient way to deal with disputes that otherwise land up in court. To get to know them better and the work they’re doing we interviewed Aman Sanghavi, Co-Founder of Presolv360 as follows:

Introduce your Team

By way of introduction, I am Aman Sanghavi, one of the co-founders of Presolv360, alongwith Namita Shah and Bhaven Shah.

Namita Shah (27 years) and Bhaven Shah (27 years) are Chartered Accountants and have completed their law from Government Law College, Mumbai. Namita is also a Certified Public Accountant (CPA) from the USA. I, Aman Sanghavi (26 years) hail from the Insurance and Management background and I am also a Certified Mediator from the Indian Institute of Corporate Affairs, Ministry of Corporate Affairs – Government of India.

Namita has previously worked with Ramesh Rajni & Co., a CA firm catering primarily to the diamond and jewellery industry, and with Ernst & Young, in their audit and assurance department. She has worked on several matters involving commercial disputes pertaining to the diamond industry and has also undertaken the cybercrime management certificate course by the ‘Asian School of Cyber Laws’.

Bhaven has previously worked with KPMG in their M&A and tax litigation practice, R. K. Bothra & Co. in their tax and audit practice and Ernst & Young in their audit and assurance practice. Besides, Bhaven has had varied experience before judicial and quasi-judicial authorities including the Supreme Court of India, High Courts of Rajasthan and Bombay, several civil and criminal courts, and the Board for Industrial and Financial Reconstruction (BIFR).

I have several years of experience in the general insurance industry. I have previously worked with Bajaj Allianz and Bharti Axa, and handled key accounts like Twitter India, Datamatics Global, Ashapura Group, Marriout Group, Aon Global, Marsh Mclennan, Willis, and many more. One of my major KRA was to develop and maintain healthy and amicable relations with clients and deal with their issues and as such I specialized in negotiations and quick settlement of claims for various marquee clients.

What was the triggering idea to start Presolv360?

Everyone is aware that India is a difficult country to do business in, and the number one reason for that is India’s complex, slow, and inefficient judicial system. Legal cases in India last a life-time and have the ability to wipe off all your resources. My father, being a businessman had a series of lengthy and expensive litigations, some of which lasted even more than two decades. It not only affected his business but also took a great toll on his personal life and physical & mental well-being. My partners, Bhaven & Namita both had a similar experience, whether personally or professionally dealing with courts and our judicial system. Crediting our sour experiences with the courts, we decided to quit our cozy corporate jobs with an unwavering spirit to revolutionize the way people deal with disputes in India. Individuals and organizations need to move from a curative approach to deal with a dispute to a more preventive approach where they can actually protect themselves from the adversities of a dispute or litigations. With this in mind, Presolv360 was born.

Presolv360 (www.presolv360.com) is India’s first-of-its-kind cloud-based dispute management platform that blends technology, human expertise and innovation to provide exclusive dispute prevention, protection and resolution services without recourse to courts. It is quick, cost-effective and the most efficient way to deal with disputes that otherwise land up in court.

 

The Problem you seek to address

The traditional dispute resolution mechanisms like courts are plagued with a number of serious problems. Where 19th century laws still dominate dispute resolution, we aim to provide 21st century solutions to uproot these challenges.

Statistically speaking,

  1. Everyday 40,000+ cases are filed due to absence of dispute prevention mechanisms
  2. Approx. 67% disputants do not even attempt an alternative before litigating
  3. Rs. 80,000 crores p.a. is lost due to court hearings and loss of business
  4. On an average, it takes 13 years for the final disposal of a case lodged in an Indian Court
  5. There are over 3 crore cases pending in Indian Courts

Currently, the traditional system i.e. the court system is the primary form of dispute resolution. The other alternative dispute resolution mechanisms such as physical arbitration, conciliation, mediation, etc, as they exist today, have had little impact on this mounting problem.

 

How are your competitors and how you stand out from them?

Besides this, some professionals and institutions offer physical arbitration, conciliation, mediation, etc. There has been very little impact of online dispute resolution as yet.

This makes Presolv360’s approach the world’s first, in the dispute protection, litigation prevention and dispute resolution space. Presolv360’s solutions are a blend of disruptive technology, innovation and human expertise to bring utmost convenience to our users not only to effectively tackle a crisis but also prevent it from occurring altogether.

 

What are the challenges you faced or facing to spread your idea?

Everyone today is aware how slow and tedious our judicial process is, yet everytime there is a dispute, the first thought that comes to our minds is ‘I will see you in Court’. Because of lack of experienced and resourceful alternative dispute professionals and mechanism, coupled with lack of awareness among the people, somehow the out of court mechanism has not gained grounds in India as compared to any other developed countries in the world. One of the biggest challenges for us was to bring about a shift in the attitude of people from ‘I will see you in Court’ to ‘Let’s talk and sort’. We realized that there is radical need to change the approach with which people and organizations dealt with their disputes, people need to shift from being curative to preventive in nature. In order to bring about that change, we re-imagined, re-engineered and devised a 360-degree solution which not only focused on dispute resolution of on-going matters but also on dispute prevention and protection. Thus, PresolvReview and PresolvSecure were added to our services. PresolvReview helps in mitigating the probability of disputes arising out of a contract by getting it reviewed from a neutral & dispute prevention perspective by top quality experts. Through PresolvSecure, parties can secure their agreement for a year from future litigations by paying a nominal commitment fee and if a dispute does arise then resolve it at no additional cost for the covered year. The agreement can be secured once it contains the ‘Presolv Dispute Resolution Clause’ and this way the parties are incentivized and committed right from the beginning that they will choose a collaborative approach to resolve a dispute before trying any other mechanism. Thus, conflicts can be resolved at a stage of differences and disagreements itself, much before they spiral into ugly and painful legal battles.

 

Many foreign countries have already started adopting AI in legal fraternity, what are your views about Indian Legal System?

I believe its high time now that technology needs to penetrate deep into the Indian Legal system. The future of the legal industry cannot be analyzed without considering the role that technology will play to shape and enhance that future. Traditional systems are getting redundant and with more inclusion of technology, things are only going to move onwards and upwards from hereon. But I can see that things are changing in India, the government is moving away from its traditional approach to finding more modern and tech-enabled solutions. Top law firms like Cyril Amarchand Mangaldas have adopted AI for identifying, analyzing and extracting clauses from contracts, the Supreme Court has given its nod for live video streaming of court proceedings. These are positive signs for the Indian Legal industry. Here’s another example of how forthcoming the Govt has been towards imbibing modern and creative practices in the legal system. Presolv360 had recently made a representation to the Ministry of Law & Justice for its unique approach to dispute management to get some sort of support or recognition from them. Within a weeks’ time, Presolv360 was recognized by the Ministry of Law and Justice, Government of India, and listed on the website of the Department of Justice. This proves that the Ministry and the Government is committed to support and back young entrepreneurs and ventures who are using tech-enabled solutions to eradicate problems in our judicial system.

 

How are your targeted audience and how presolv360 will serve them to solve the probs?

Disputes are inevitable and are inherent to the nature of humans. Our target audience is anyone who wants to secure themselves from the adversities of disputes and those seeking to resolve their ongoing disputes collaboratively, whether or not they are pending in court. Our scope extends to individuals, SMEs, corporates, institutions and even governments. We, at Presolv360 have categorized ourselves into three services to provide a 360-degree solution to our clients:

PresolvDirect: If any person or an organization has any existing disputes (whether pending in court or likely to be submitted to court), we can assist them in resolving those disputes by using a collaborative approach, out of court. Through our platform, we aim at providing a fast track, cost effective and an effective alternative to traditional dispute resolution system in India. We believe that most disputes can be easily resolved amicably by a mere dialogue and without going through the tormenting process of court battles in the form of litigation, which not only drains off money but also time and effort.

PresolvSecure: Parties can secure their agreement for 1 year by paying a nominal commitment fee depending on the contract value and no of parties involved. Once paid, the parties have access to the online dispute management portal and if there exists any dispute in the span of 1 year, they can resolve their disputes amicably at the click of a button at ZERO costs. An expert from our panel will be assigned to the case who will always be available to assist parties to reach an amicable resolution. For a small annual fee (starting from mere Rs 2,000/-), the parties can safeguard themselves from prohibitive costs, traumatic experiences, time-consuming processes and ruined relationships, and instead ensure a speedy and effective resolution by our empaneled experts.

PresolvReview: Preventing disputes is one of the key objectives of Presolv360. With PresolvReview, our expert will review your agreement from a dispute prevention standpoint and make suitable suggestions and recommendations so that you can enjoy a dispute-free relationship and a hassle-free life at the most affordable costs. The cost for agreement review ranges from Rs 750/- to Rs 8,000/- depending on the type and complexity of the agreement.

We have also launched the ‘Presolv for All‘ Project that extends the services of Presolv360 free of cost to weaker sections and low-income groups to ensure that we, as a community, can enjoy a litigation-free future.

 

Have you received/applied investment/angel funding or any plans?

With an innovative and disruptive approach to dispute management at our hands, we have received massive encouragement and interests from few individuals for funding. But currently, we are bootstrapped and will be looking at raising funds in the near future since we will be constantly expanding and upgrading our team and technology, and continually innovating for world-class dispute prevention solutions. The entire model for Presolv360 has been built keeping in mind self-sustenance on one hand and affordability, efficiency and convenience on the other. This way Presolv360 will build a financially rewarding, socially impactful and a valuable business enterprise.

 

How big is your staff and in next one year what is your plan?

Presolv360 is powered by a team of 14 members (including 6 dispute resolution and legal experts) with an unbreakable spirit and the determination to change the way India and her citizens deal with disputes.

In the coming months, our primary focus will be to capitalize on the first-mover
advantage, constantly build a strong team and undertake market development for
PresolvSecure — a completely new and revolutionary service in the dispute management
space. We will also work on penetration of PresolvDirect, as the best online
collaborative dispute resolution tool. Since dispute can be prevented easily at an
affordable cost, we will ensure that we can make PresolvReview available to larger
audience mainly focusing on SME’s and startups.
