4 things you need to be sure of before filing for divorce

Couples separate for all kinds of reasons, and thankfully many find a way to resolve their underlying relationship issues. For others, however, it’s not that simple and the only option left is to file for divorce. From adultery to unreasonable behaviours, abuse, addictions, or even a lack of intimacy – these are just some of the most common causes behind divorce proceedings today.

If you’re someone who is considering filing for divorce, the idea of being legally set free from your partner is both a welcoming and potentially overwhelming outcome. Be sure you’re doing the right thing

We all say and do things in the heat of the moment. Divorce is often seen as the last resort, and some couples head to mediation, counselling or couples therapy in the hope of moving on together and making their relationship stronger. Consider the custody situation

If you and your partner have children, then this is another factor you’ll need to contemplate. Sharing custody is incredibly stressful and emotionally draining for everyone involved. Being able to sit down together to work out an arrangement that benefits everyone (especially your children) will make the entire process much easier and less painful.

Gather all the relevant files

Phone records, joint account statements, the deeds to your shared properties, business accounts and ownership documents – before you file for divorce make sure you have hard and digital copies of all the files you think will be relevant. It may be difficult to obtain these files further down the line, especially if your spouse has reacted poorly to your decision to divorce them. Consider being one step ahead and get everything you need before you file. 

And finally, decide on your living arrangements

If you’ll be unable to live in the home you currently share with your partner, then making other living arrangements (including for the children) is essential. Bear in mind that if you’re hoping to retain the marital home, then you should be wary of walking away at this stage. Speak with your divorce lawyer to discuss the best options for you.
