4 Tips for Launching a Medical  Malpractice Lawsuit

People look to doctors for whatever medical emergencies they have to deal with. From child delivery to a major surgical procedure to a bullet wound from a reckless police officer, medical professionals are always there to help us live healthier lives.

But not all medical procedures end well. And though it’s rare for doctors and nurses to make errors, the risk of injury is still very much possible. Considering that medical professionals are responsible for your safety, it is fair to demand accountability and get compensated if negligent care caused harm.

Launching a medical malpractice lawsuit maybe your best course of action. If you or someone you know is a victim of injury caused by the negligence of a medical professional, keep these tips in mind:

  1. Consider the statute of limitations

Since a malpractice claim is a type of personal injury claim, there is a timeline you will need to follow if you are intent on filing a lawsuit against a clinic or doctor. In other words, there is a deadline you will have to meet for your complaint to stand. In Washington State, complaints can be filed no longer than three years after the injury. In Texas, on the other hand, you have two years to launch a lawsuit before the statute of limitations runs out.

  1. Determine the merits of your case

Aside from the timetable, it’s also important to know if malpractice did happen during your medical care. That said, you have to gather all relevant facts pertaining to the case. You will have to prove that your injuries were caused by a medical practitioner’s negligence or recklessness. For this, you might want to set a meeting with another physician who can check your medical records and see whether the professional at fault did commit serious lapses. That way, the attorney you hired can work to help build a solid case.

  1. Find the right lawyer

After determining the timeliness and validity of your lawsuit, you will need to find an attorney that specializes in medical malpractice claims. Sure you can find just about any lawyer to represent you, but you can get better outcomes by hiring someone with proven experience in handling malpractice cases.
